CHOOSING THE RIGHT EXECUTOR: Key Qualities for Your Estate Plan

As an estate planning attorney, one of the most crucial decisions I help clients make is selecting an executor for their will. This person will be responsible for managing your estate and ensuring your final wishes are carried out. Here are the essential qualities to look for in an executor.

Trustworthiness and Integrity

First and foremost, your executor must be someone you trust completely. They will handle your assets, pay debts, and distribute inheritances. Choose someone known for their honesty and strong moral character.

Financial Responsibility

Your executor should have experience managing money and a track record of financial responsibility. They'll need to handle bank accounts, investments, and potentially complex financial transactions.

Organization and Attention to Detail

Estate administration involves numerous deadlines, documents, and legal requirements. Your executor should be organized and detail-oriented to manage these responsibilities effectively.

Good Communication Skills

An executor must communicate with beneficiaries, attorneys, accountants, and financial institutions. Strong interpersonal skills help prevent misunderstandings and maintain family harmony. This includes a willingness to ask questions and ask for help when they’re unsure or need it.

Time and Availability

Settling an estate typically takes 6-12 months or longer. Your executor should have the time and flexibility to handle these responsibilities alongside their other commitments.

Local Proximity (Preferably)

While not absolutely necessary, having an executor who lives nearby can make the process smoother, as they may need to handle property, attend court hearings, or meet with various professionals in person. Our local courts have traditionally preferred executors local to the Court in which the probate action is filed.

Remember, you can also name alternative executors in case your first choice is unable or unwilling to serve when the time comes. You should review your current estate plan annually. Our recommendation is to do it on or around your birthday as that is not a date you will readily forget.
